N.J. Legislature Challenges Murphy-Era Resiliency Rule

Department of Environmental Protection overstepped its authority in adopting a controversial resiliency measure, the state Legislature has moved to curb its actions by demanding the agency respect constitutional tenets and wait for additional legislative direction on how to protect residents from climate change.
Senate Concurrent Resolution 106, introduced by Sen. Nicholas P. Scutari (D-22nd) on Feb. 24, criticizes the rule’s adoption process, claiming it lacked adequate economic, housing and job impact assessments. It emphasizes that the “impacts of rules and regulations of this magnitude should be carefully studied prior to implementation.”
